Offer Deposits in Alberta at a Glance
- There is no fixed deposit amount in Alberta. It's negotiated in the offer.
- The deposit is held in trust, usually by a brokerage.
- It's credited toward the purchase price at closing.
- Contract terms determine what happens to the deposit if the deal doesn't proceed.
How Much Is Typical?
Deposits are often a few percent of the purchase price, but they vary with the price, competition, and circumstances. A larger deposit can show a seller that you're serious, especially in a competitive situation.
Initial and Additional Deposits
Some contracts call for an initial deposit when the offer is accepted, followed by an additional deposit once conditions are removed. Deposits must be delivered within the time stated in the contract.
Where Your Deposit Goes
Your deposit is typically held in a brokerage's trust account. On closing, it's applied to your down payment through your lawyer.
If the Sale Doesn't Complete
- If a condition isn't satisfied and the contract ends properly, the deposit is generally returned.
- If a buyer fails to complete a firm purchase, they may lose the deposit and could face additional claims from the seller.
Planning Your Funds
Make sure your deposit funds are available before submitting an offer. I'll explain the deposit terms in the contract and help you choose an amount that fits your situation and the market.
